2. Services & Product Catalog

DM Creative Gifts operates an online store specializing in women's accessories, customized jewelry, kids' stationery, kids' return gifts, event return gifts (for festive occasions, birthdays, weddings, baby showers, etc.), handmade candles, resin items, curated gift hampers, personalized items, and related giftware.

3. Product Handmade & Customization Disclaimer

Handmade Variations: Due to the artisanal and handmade nature of our items (including resin art, custom jewelry, and handcrafted candles), minor variations in color, texture, shade, dimensions, or subtle inclusions (such as natural micro-bubbles in resin) are inherent. These variations are characteristics of craftsmanship and shall not be classified as defects.

Personalized Content: You are responsible for verifying all names, dates, text, and details provided for personalized gifts. DM Creative Gifts is not liable for errors in final products resulting from incorrect information provided by the customer at the time of order placement.

4. Custom Orders, Cancellations & No Returns

No Returns or Refunds: DM Creative Gifts does not offer returns, exchanges, or refunds. All sales are final once the order is confirmed.

Custom & Bulk Orders: Personalized items, customized jewelry, and bulk return gift orders enter production shortly after confirmation. Once production has commenced, these orders cannot be canceled.

Damaged or Incorrect Items: If an item arrives damaged, defective, or different from what you ordered, contact us within 48 hours of delivery via WhatsApp or email with clear photos of the product and packaging. We may arrange a replacement after verification. Handmade variations in color, texture, shade, or size are not treated as defects.

5. Intellectual Property & Customer Uploads

All content, photos, graphics, branding, and design layouts displayed on the DM Creative Gifts platform are the intellectual property of DM Creative Gifts.

If you upload or submit photos, logos, or artwork for gift personalization, you warrant that you own or hold appropriate licenses for that content. You agree not to submit copyright-infringing, unlawful, or offensive material.

6. Pricing, Payments & Delivery

All prices are listed in Indian Rupees (INR) and include applicable taxes as shown at checkout. Payments are accepted via UPI (Google Pay, PhonePe, and other UPI apps) using the QR code or UPI ID shown at checkout. Orders are confirmed after you submit the 12-digit UTR for verification.

Delivery timelines are estimated. DM Creative Gifts is not liable for logistics delays caused by third-party courier services, incorrect shipping addresses provided by the user, or events of force majeure (weather disruptions, strikes, natural disasters).

7. Eligibility

By using this website, you confirm that you are at least 18 years of age. If you are under 18, you may use the site only with the involvement of a parent or legal guardian.

8. Limitation of Liability & Governing Law

DM Creative Gifts shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our products or services. These Terms shall be governed by and construed in accordance with the laws of India, and any legal disputes shall be subject to the exclusive jurisdiction of the courts located in Coimbatore, Tamil Nadu.

Personal Contact Details: Name, email address, phone number, shipping address, and billing address.
Personalization Data: Photos, names, text, dates, or messages submitted specifically to customize products (e.g., hampers, custom jewelry, personalized return gifts).
Account & Technical Data: Phone number used for OTP login, and order history stored via Google Firebase (Authentication and Firestore) so we can process and display your orders.
Payment Information: We accept payments via Google Pay (GPay), UPI apps, and QR code scanning at checkout. After you pay, you submit a 12-digit UTR (transaction reference) so we can verify the payment. We do not store your UPI PIN, bank passwords, or card details on our servers.

2. How We Use Your Information

We use your collected data strictly for:

Processing, crafting, packaging, and dispatching your orders.
Sending order status updates, tracking details, and customer service communications via WhatsApp, SMS, or email.
Improving our product catalog, website functionality, and customer experience.

3. Customization Content Confidentiality

Photos, names, and personal details provided for custom products are kept confidential and used strictly for crafting your order. We will not use photos of your custom gifts or personal milestones for promotional or marketing purposes without your prior verbal or written consent.

4. Information Sharing & Third Parties

We respect your privacy and do not sell or rent your personal data to third parties. We share limited necessary data only with trusted partners strictly required to fulfill your order:

Logistics & Courier Partners: Name, delivery address, and contact number shared for delivery execution.
UPI Apps & Banks: Your payment is processed by your UPI app and bank. We only receive the UTR reference you provide so we can verify the order.
Legal Compliance: Information disclosed only if required by Indian law or government authorities under official requests.

5. Data Security

We implement appropriate administrative, technical, and physical safeguards to protect your personal information against unauthorized access, loss, or misuse.

What are the delivery timelines? Custom handmade products usually take 5-7 business days to craft and ship.
Can I return a gift? We do not offer returns, exchanges, or refunds. All sales are final. If an item arrives damaged or incorrect, contact us within 48 hours with photos and we may arrange a replacement.
Where is my UTR? After you pay via GPay, PhonePe, or any UPI app, open the payment success screen or bank SMS. The 12-digit UPI transaction reference / UTR is shown there. Enter that number on the checkout payment screen to confirm your order.
